Procedures for obtaining a Legal Heir Certificate

Legal Heir Certificate is needed for the heirs of a serving or retired employee, who deceased. If the head of a family dead then the next direct legal heir of deceased can apply for Succession Certificate. This can be for the purposes of �House Tax , transfer of �Electricity connection, �Patta transfer /Telephone connection, Bank Account Transfer, Filing of IT Returns, etc. If the deceased person is a government servant then the legal heir certificate is issued for sanction of pension or for receiving an appointment on the concerned level.


In case if the death of a person is without a valid will for the transactions of banks and financial institutions, court litigation etc. a Legal heir Certificate is not valid. Succession Certificate is issued by a civil court on the necessary application in such cases. If a person is nominated in advance then Succession Certificate is not required after the death of the person in bank cases. So it is advisable to nominate someone as a precaution.

Don�t get confused between Legal heir certificate and succession certificate. Both of them are totally different. Succession certificate is issued by court whereas Legal Heir certificate is issued by Tahsildar of the district.

Usually, Legal Heir Certificate mentions the names, relationship with the deceased, ages, and marital status of surviving family members.

For obtaining Legal Heir Certificate, a death certificate showing proof of death is necessary. This death certificate is issued by the Corporation/ Municipality / RO of Mandal where the death occurred/ Major Panchayat.

Wife or Husband or Son or Daughter or Mother are eligible to apply for legal heirship certificate.

Required Information to obtain Legal Heir Certificate is a Deceased name, Names, and Relationship of Family member, �Signature of Applicant, Date of Application, Residential Address, Death Certificate, Rights of Record.

Required Documents to obtain Death certificate Legal Heir Certificate is Identity Card, Ration Card and Prescribed application form.

Some of the important things considered for obtaining Legal Heir certificate are:

District Tahsildar office issues Legal heir certificate for those individuals whose husband or parent is dead without leaving a will.

This certificate is used for establishing a relationship for claims related to Insurance, pension, retirement benefits or other service benefits of central and state government departments as well as Government undertakings etc.

To get employments for example compassionate appointments.

With the death certificate approach the District Tahsildar office and produce the form.

All required documents need to be submitted while filing the application.

It may take around a month to process all the necessary information and to obtain the certificate.

Procedures

Legal Heir certificate is obtained through your Taluk / Thasildhar or through the District Civil Court of your area.

By approaching� Taluk / Thasildhar office, they should be able to provide you with the certificate or in some case, you may have to contact a lawyer in District Civil Court to obtain the certificate.

This certificate is issued by the Concerned Authority mentioning the names of all legal heirs of the deceased person as per the report of the Village Administrative Officer and Revenue Inspector and after enquiry.

In case if certificate is not issued within reasonable time then we can remind the tahsildar and in case if there is no any response from the concerned authorities then we can contact RDO/sub-collector.
